Terms of Service for the planbe.eco website

§1. General provisions

  1. These Terms of Service (hereinafter: Terms) define the rules for using the website at planbe.eco and its subdomains (hereinafter: Website) and for services provided electronically by Plan Be Eco Sp. z o.o.
  2. The operator of the Website and service provider is Plan Be Eco Sp. z o.o., with its registered office in Warsaw (01-001), Al. Jana Pawła II 43A, unit 37B, entered in the register of entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw under number KRS 0000877966, VAT ID 5272946662, REGON 387900015 (hereinafter: Plan Be Eco).

  4. The Terms are made available free of charge in a form that allows them to be acquired, reproduced and retained using the teleinformatic system used by the User.

§2. Definitions

  • User - any natural person, legal entity or organizational unit using the Website.
  • Services - services provided electronically by Plan Be Eco through the Website, including: providing information and educational content, contact forms, webinar sign-ups, newsletter, and redirects to separate Plan Be Eco applications (including supplier.planbe.eco).
  • Content - texts, graphics, videos, audio, data and other materials made available on the Website.
  • Applications - separate Plan Be Eco software (e.g. the supplier.planbe.eco platform), the use of which is governed by separate agreements and terms.

§3. Scope and types of services

  1. Through the Website, Plan Be Eco provides the following services free of charge:
    • provision of information, educational and marketing content,
    • contact via contact forms,
    • sign-up for free webinars and events,
    • newsletter subscription.
  2. Access to paid functionalities of the Plan Be Eco platform takes place in separate Applications and is governed by separate agreements and terms.

§4. Technical conditions and security

  1. Using the Website requires: a device with internet access, an up-to-date web browser (Chrome, Firefox, Safari, Edge) with JavaScript and cookies enabled, and an active email account for receiving communications.
  2. Plan Be Eco applies technical and organizational measures to ensure the security of data transmitted, in particular TLS encryption.
  3. The User agrees not to take actions that could disrupt the operation of the Website, including not introducing unlawful content, not sending malicious software, and not circumventing technical security measures.

§5. User rights and obligations

  1. The User is obliged to use the Website in accordance with its intended purpose, applicable law, good practices and the provisions of the Terms.
  2. By providing data in Website forms, the User declares that they are truthful and up-to-date, and that they have the right to share them.
  3. The User is prohibited from providing content of an unlawful nature.

§6. Intellectual property

  1. All Content published on the Website, including logos, names, graphics, texts and the layout of the Website, is subject to copyright or other rights held by Plan Be Eco or third parties.
  2. Use of the Content is permitted only within the scope of permitted personal use or after obtaining prior written consent from the rights holder.

§7. Liability

  1. Plan Be Eco exercises due diligence to ensure that information published on the Website is accurate and up-to-date, but does not guarantee its completeness or suitability for a specific purpose. The Content is informational in nature and does not constitute legal, tax or investment advice.
  2. The results of any calculators and tools made available on the Website are indicative.
  3. Plan Be Eco is not liable for interruptions in access to the Website resulting from causes beyond its control (e.g. connection failures, force majeure, scheduled maintenance work).
  4. Plan Be Eco is not liable for content provided by third parties to which links on the Website lead.

§8. Personal data and cookies

  1. The controller of Users' personal data is Plan Be Eco. Detailed rules for data processing are set out in the Privacy Policy.
  2. The Website uses cookies to the extent described in the Privacy Policy. The User can manage cookie consent at any time through browser settings.

§9. Complaints

  1. Complaints regarding Services provided on the Website may be submitted to the email address [email protected].
  2. The complaint should include: the User's contact details, a description of the problem, and the expected method of resolution.
  3. Plan Be Eco processes complaints within 14 days of their receipt and informs the User of the outcome at the indicated email address.

§10. Changes to the Terms

  1. Plan Be Eco reserves the right to amend the Terms, in particular in the case of changes in law, changes in Website functionality or for other justified reasons.
  2. The current Terms are published on the Website each time. Changes take effect on the date of publication, unless otherwise indicated.
  3. Continued use of the Website after the changes take effect constitutes their acceptance.

§11. Final provisions

  1. In matters not regulated by the Terms, the provisions of Polish law apply, in particular the Civil Code and the Act of 18 July 2002 on the provision of electronic services.
  2. Any disputes arising from the use of the Website will be resolved amicably, and in the event of lack of agreement - by the court competent for the registered office of Plan Be Eco, subject to mandatory provisions regarding consumers.
  3. A consumer may use out-of-court methods of dispute resolution, including the online ODR platform.
